Terms of Service
Mutatum is a self-directed clerical and educational technological utility designed to assist self-represented (pro se) individuals in organizing their financial records, analyzing debt buyer statutes of limitations, and generating clerical paperwork. Mutatum is not an attorney, not a law firm, and does not provide legal representation, legal advice, legal opinions, or court advocacy. No attorney-client relationship is created through the use of this software. Citizens exercise their fundamental and statutory rights of self-representation under 28 U.S.C. § 1654 and corresponding state constitutions and civil practice acts.
Acceptance of Terms
By accessing, executing, downloading, or utilizing Mutatum (whether hosted on expeditum.dev, downloaded as an offline HTML kit, or accessed through mutatum.app), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you must discontinue use immediately.
Strict Non-Law Firm & Non-CROA Disclosures
To ensure absolute clarity regarding the nature of Mutatum:
- Not a Law Firm: Mutatum does not practice law. It does not assess the merits of your lawsuit, select causes of action on your behalf, or represent you before any municipal, state, or federal court. The software provides deterministic clerical document drafting based solely on user inputs.
- Not a Credit Repair Organization: Mutatum is not a "Credit Repair Organization" as defined under the federal Credit Repair Organizations Act (CROA, 15 U.S.C. § 1679a). Mutatum does not charge any money, charges zero monthly subscriptions, and provides no fee-based debt negotiation or credit counseling services.
- Self-Directed Pro Se Rights: Under 28 U.S.C. § 1654, litigants in all courts of the United States may plead and conduct their own cases personally or by counsel. Mutatum empowers self-represented individuals to assert their rights without fee extortion.
User Responsibilities in Court Proceedings
If you have been served with a court summons or lawsuit by a junk debt buyer (such as LVNV Funding, Midland Credit Management, or Portfolio Recovery Associates):
- Court Deadlines: You are solely responsible for calculating and meeting all answer and appearance deadlines (typically 21–30 days depending on state and county civil rules). Mutatum’s countdown timers are reference tools based on statutory defaults.
- Filing & Service: You must personally file your Pro Se Appearance and Answer with your local county circuit court clerk and serve a copy on plaintiff’s counsel via certified mail or e-service in accordance with local court rules.
- Court Appearances: You must appear at all scheduled status hearings, case management conferences, and trial dates. Failure to appear will result in an adverse default judgment regardless of the merits of your affirmative defenses.
- Local Procedural Rules: You must verify fee waiver forms (e.g., Application for Waiver of Court Fees / 735 ILCS 5/5-105) and county-specific electronic filing requirements (e.g., Odyssey eFileIL).
Statute of Limitations & Evidentiary Calculations
Mutatum calculates Statute of Limitations (SOL) expiration using codified state statutes (e.g., Illinois 5-year unwritten debt limit under 735 ILCS 5/13-205). Users must confirm:
- The true Date of First Delinquency (DOFD) on the original account.
- Whether any partial payment was made that could toll or revive the statute.
- Choice of law provisions that may govern the original creditor agreement.
License to Use & Air-Gapped Rights
Mutatum grants all users a personal, non-exclusive, worldwide, royalty-free license to use, download, copy, and run the software for lawful personal debt defense and financial recovery. Users may store the standalone offline file indefinitely without fear of licensing revocation or remote disabling.
Disclaimer of Warranties ("As-Is")
Mutatum is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or that litigation documents will result in dismissal of lawsuits or deletion of credit entries. The law is dynamic, and judicial interpretations vary across jurisdictions.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Mutatum, its developers, contributors, or hosting providers be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use this software, including court judgment entries, garnishments, or missed statutory deadlines.
Governing Framework & Modifications
These Terms of Service are governed by the general laws of the State of Illinois and federal consumer protection statutes (FDCPA, FCRA). We reserve the right to modify these terms as civil procedures evolve. Updated terms will be posted with an updated effective date.
